Privacy Policy – HireQ App

HireQ App is an application (“HireQ App” or “HireQ App Platform”) that allows users to easily search for job offers and apply to them, while monitoring the status of the submitted application, access to the database of industry articles. The HireQ App platform offers a browsing service provided within the Platform. HireQApp of job offers according to the criteria selected by the user, creating a user profile by entering personal data, applying to job offers selected by the user, monitoring the status of submitted applications, notifying the user about changes in the application status via push notifications (jointly: “Functionalities” or “Services” ). The security of your personal data is very important to us. We want their processing to be carried out in accordance with the highest standards, which is why we have prepared this Privacy Policy (“Privacy Policy”, “Policy”), which describes how and for what purpose we process your personal data and what rights you have in relation to your use of the HireQ App Platform.
This Privacy Policy applies to people interested in job offers and articles published on the HireQ App Platform, who have a User Account on the HireQ App Platform (“Users”). This Policy applies only to the processing of personal data by us. This Policy does not apply to any sites or services owned or operated by third parties that may be linked from the HireQ App Platform. Hi-Re is not responsible for the content or privacy standards and policies of any sites or services owned or operated by third parties that may be linked from the HireQ App Platform.
Personal data means any data relating to an identified or identifiable natural person (“You”, “User”). The terms used in this Privacy Policy, including in particular: “personal data”, “data subject”, “processing”, “data controller”, “processor” and “supervisory authority” have the meaning given to them in the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (“GDPR”), unless expressly otherwise indicated.
The operator of the HireQ App Platform is Hi-Re, a limited liability company based in Krakow, at ul. Józefa Marcika 6, 30-443 Kraków, entered into the Register of Entrepreneurs of the National Court Register under KRS number 0000767479, the registration documentation of which is kept by the District Court for Kraków-Śródmieście in Kraków, 11th Commercial Division of the National Court Register, NIP: 6793181837, REGON: 382352390 , with a share capital of PLN 5,000.00 (“Hi-Re”),

COLLECTION OF PERSONAL DATA

USING THE HIREQ APP PLATFORM

All visitors (“guests”) can use the basic functions of the HireQ App available at www.hireq.pl without registration. (“HireQ App”). Our platform may use cookies and other similar technologies (“cookies”). Cookies are small text files sent by our website or third parties via our website and stored on your device and then read by your web browser. Cookies are a technology commonly used to store and transmit information, enabling, inter alia, remembering the User’s settings and preferences, collecting statistics and optimizing websites, personalizing the displayed content and matching advertisements. A detailed description of the purpose and method of collecting cookies by us can be found at www.hireq.pl, which contains our Cookie Policy, also specifying, among others: what categories of personal data, how and for what purpose we process as part of the HireQ App Platform and what rights you have in connection with our use of cookies and other similar technologies.
USERS
Access to the Functionalities of the HireQ App Platform for Users requires registration of a User Account (allowing the use of services offered within the HireQ App Platform) (“User Account”). Your User Account will allow you to authenticate within the HireQ App platform and use its Functionalities. During registration, we may require you to provide certain personal data necessary for authentication so that we can identify you as a person who can access the HireQ App Platform and its Functionalities, as well as data necessary to communicate with you.

WHY DO WE PROCESS YOUR PERSONAL DATA?

Personal data of the User are processed for the following purposes:
to conclude a contract with the User and perform the contract to which the User is a party, including the provision of electronic services to the User of the HireQ App Platform and providing access to Functionalities;
to transfer the User’s personal data for the purpose of submitting and monitoring the submitted application for a job offer via the HireQ App Platform;
to ensure that the User has the necessary qualifications and to enable the best possible cooperation between the User and the entity looking for an employee;
in connection with running profiles and fanpage in social media, sending a newsletter, informing about our offer and offered promotions, as well as conducting surveys, sending invitations and other direct marketing communication using social media, e-mail, notifications, messengers Internet, phone calls, text messages and traditional correspondence;
to fulfill the legal obligations incumbent on Hi-Re, resulting in particular from tax and accounting regulations, as well as regarding counteracting money laundering and financing of terrorism;
for purposes resulting from the legitimate interests pursued by Hi-Re, i.e. maintaining relationships with the User, monitoring and analyzing the way you use the HireQ App Platform, improving the User experience, improving the performance and quality and developing the HireQ App Platform, ensuring data security and information, fight against fraud and abuse or if necessary for the establishment, exercise or defense of legal claims.
Data as part of individual services are collected and processed in a manner described in detail in the Regulations for the use of the HireQ App Platform, which you can find at: www.hireq.pl.

WHAT PERSONAL DATA DO WE PROCESS?

We process, in particular, the following categories of personal data:
first name (names) and surname,
Address for correspondence,
Date of birth,
function or position held,
academic, honorary, military or other title and academic degree,
PESEL number, and in the absence of such number – the type and number of the document confirming identity,
NIP and REGON number,
e-mail adress,
Phone number,
other contact details,
name and address of a sole proprietorship or company,
User’s image,
Bank account number,
area of the User’s activity, knowledge of foreign languages, competences,
information about the User’s education and experience,
information on the work performed by the User and his working hours,
billing information.
We may also request the provision of personal data other than those indicated above, when it is necessary to conclude or perform a contract concluded with us, or to exercise the right or fulfill an obligation resulting from legal provisions.
The provision of personal data is voluntary, but failure to provide it – depending on the circumstances – may prevent the registration of the User Account or the use of the Functionalities of the HireQ App Platform.

WHAT IS THE LEGAL BASIS FOR THE PROCESSING OF PERSONAL DATA?

In connection with the registration of the User Account and the use of the Functionalities of the HireQ App Platform, we process personal data in accordance with art. 6 sec. 1 lit. b of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (“GDPR”) ( Official Journal of the European Union L 119 of 04/05/2016, p. 1, as amended4).
We can also process personal data when it is necessary to fulfill the legal obligations incumbent on Hi-Re (Article 6 (1) (c) of the GDPR) and based on our legitimate interest in, in particular, establishing and protecting our rights or pursuing claims. (Article 6 (1) (f) of the GDPR).
In connection with informing about our activities, we process personal data based on our legitimate interest in accordance with art. 6 sec. 1 lit. f GDPR. If the applicable law requires consent to send commercial information to a designated recipient who is a natural person by means of electronic communication, in particular e-mail, we process personal data in connection with informing about our activities based on (voluntary, specific, informed and unambiguous) consent pursuant to art. 6 sec. 1 lit. a GDPR.
From time to time, we may ask for consent (Article 6 (1) (a) of the GDPR) for the processing of personal data for purposes that may not be directly related to your use of the HireQ App Platform.
In addition, we process personal data on the basis and as part of legal obligations (e.g. accounting or tax law or upon request to disclose personal data to competent authorities in accordance with the law) (i.e. pursuant to Article 6 (1) (c) of the RODO).

FOR WHAT PERIOD WILL WE PROCESS YOUR PERSONAL DATA?

We will process personal data during the term of the contract concluded by Hi-Re with the User regarding the User’s use of the Functionalities of the HireQ App Platform and for the period of limitation of claims arising from the concluded contracts (as a rule, for a period of six years from the end of the year in which the contract was terminated or has expired). After the expiry of the above-mentioned periods, the data will be deleted, unless their further storage is an obligation resulting from legal provisions, it remains necessary for the fulfillment of contractual obligations, for the establishment and protection of our rights or for pursuing claims, or if further processing is possible or necessary by law in based on a basis other than consent.
Notwithstanding the foregoing, if the basis for the processing of personal data is your consent, you have the right to withdraw this consent at any time (however, the withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal). We will immediately stop processing the data in the event of the consent being withdrawn, unless further processing is possible or necessary by law on a basis other than consent. The consent may be withdrawn by direct contact with Hi-Re or by setting it on the User Account.

AUTOMATIC PROCESSING (INCLUDING PROFILING)

Personal data may be processed automatically, in particular for the purpose of adapting the content of the website to the User’s preferences, optimizing the process of using websites, sending messages, statistical analysis or presenting personalized marketing content. The automatic processing of data will not have legal effects or similarly significantly affect the data subject.

WHERE DO WE STORE YOUR PERSONAL DATA?

Your personal data will be stored in the countries of the European Economic Area (“EEA”). However, some of the services we use (e.g. document cloud storage) may require data transfer and processing outside the EEA. Each such transfer of personal data will be compliant with applicable regulations and will be based on appropriate legal safeguards, i.e. the recipient is located in a country that ensures an adequate level of personal data protection or under a legal instrument that meets the requirements of the GDPR (such as the so-called standard contractual clauses data protection approved by the European Commission).

WHO DO WE SHARE YOUR PERSONAL DATA WITH?

Service providers and partners
We may share personal data with technical service providers, e.g. hosting, payment and mailing services, to ensure communication with the User, analytical services related to the study of the manner of interaction with the website or collection of website usage statistics in order to improve and optimize it, as well as personalized advertising and to provide the ability to share content on social networks and external websites.
We use in particular the following services: hosting (hostinger.pl), user relations (including live chat software) (Viber, Whats App, Facebook, Instagram), payment services (…), analytical services ( Google Analytics), mailing services (hostinger.pl). In addition, we work with providers of other services supporting the HireQ App Platform, including to ensure high-quality customer service, user satisfaction and safety.
We can also provide the necessary personal data to entities providing us with: accounting, HR and payroll services, marketing services, IT services, financial services, legal services, consulting services and other services related to running a business.
Entities processing personal data as part of the services we provide are obliged to ensure their protection and respect your rights in accordance with applicable law.
Affiliates, acquisitions and restructuring
In the event of a merger or acquisition, as well as reorganization of our business, undertaking joint ventures with other entities and spinning off or divesting all or part of our business, we may transfer some or all personal data to other entities (in particular to the acquirer and legal successor). Personal data may also be made available in the event of restructuring, bankruptcy or the establishment of a compulsory administration.
Legal obligations and security
We may transfer personal data to competent administrative authorities, institutions and other authorized entities in the country and abroad if required by applicable law, as well as at the request of the above. bodies, institutions and entities as part of the procedures provided for by law (e.g. at the request of a court, law enforcement authority or enforcement authority). We may also transfer personal data to authorities, institutions and third parties for the purpose ensuring the safety of Users, combating fraud and abuse, or if it is necessary to establish, exercise or defend legal claims.
Advertisers
Customer data may be transferred to the advertiser selected as part of the application service for job offers in order to submit an application for a job offer via the HireQ App Platform.

HOW WE PROTECT YOUR PERSONAL DATA

We implement appropriate organizational, technical and physical safeguards to protect personal data, taking into account (i) the current state of knowledge, (ii) implementation costs, (iii) the nature, scope, context and purposes of processing, and (iv) the risk to you.

WHAT RIGHTS DO YOU HAVE?

In connection with the processing of personal data, you use many rights that are guaranteed by applicable law:
the right to access personal data (and receive a copy thereof),
the right to data portability,
the right to rectify (correct) personal data,
the right to delete personal data,
the right to limit processing,
the right to withdraw consent to processing,
the right to object to the processing of personal data,
the right to object to direct marketing (object to processing for direct marketing purposes),
the right to lodge a complaint with a supervisory authority.

HOW CAN YOU EXPLORE YOUR RIGHTS?

The law does not require any specific form or method of communication to exercise your rights. However, we attach great importance to ensuring the effective possibility of their implementation, which is why we have provided a dedicated contact channel via e-mail to handle inquiries, notifications and applications related to the implementation of the above rights: hello@hi-re.pl.
Remember also that you can exercise certain rights (e.g. you can review and update your personal data) by logging in to the User Account on the HireQ App Platform.

RIGHT TO SUBMIT A COMPLAINT WITH A SUPERVISORY AUTHORITY

If, in your opinion, we process your personal data inappropriately, you can always contact us as well as lodge a complaint with the supervisory body (the President of the Personal Data Protection Office).

CHANGES TO THE PRIVACY POLICY

If our personal data processing practices change or it is necessary to amend this Privacy Policy in accordance with applicable law, case law or guidelines issued by competent authorities or courts, we will be entitled to unilaterally amend this Privacy Policy at any time. If these changes are material – will affect your rights and obligations – we will notify you in advance of the changes coming into force. Changes to the Privacy Policy will be made available on the HireQ App Platform.

RELEVANT LAW

The processing of personal data by Hi-Re is subject to the law of the Republic of Poland.
